§ 851. Desertion of children under age of ten a felony

Any parent of any child or children under the age of ten (10) years, and every person to whom such child or children have been confided for nurture or education, who deserts such child or children within Cherokee Nation, or takes such child or children out of Cherokee Nation, with the intent wholly to abandon it, shall be deemed guilty of a felony punishable by a term of imprisonment not to exceed three (3) years and a fine not to exceed Fifteen Thousand Dollars ($15,000.00), or both.
