Rape in the second degree is a felony punishable by a term of imprisonment not to exceed three (3) years or by imposition of a fine in an amount not the exceed Fifteen Thousand Dollars ($15,000), or by both such fine an imprisonment. Any person convicted of a subsequent violation of rape in the second degree shall be guilty of a felony punishable as provided in this subsection and shall not be eligible for probation, suspended or deferred sentence.
