§ 2208.1. Exception for Marijuana

Any act or omission involving medical or minor offenses of use or possession of marijuana, which would not be punishable if committed or omitted within the jurisdiction of the State of Oklahoma, or which would subject the individual to a lessor punishment than prescribed herein, by the laws thereof in force at the time of such act or omission, shall not be guilty under the laws of the Cherokee Nation or not subject to more severe punishment under the laws of the Cherokee Nation.
Provided that whoever commits an act or omission involving marijuana which would be punishable if committed or omitted within the jurisdiction of the State of Oklahoma, by the laws thereof in force at the time of such act or omission, shall be guilty under the laws of the Cherokee Nation of a like offense and subject to a like punishment.
