§ 5. Representation by District

A. Commencing with the Council elections of 2025, there shall be seventeen (17) seats comprising the Tribal Council of the Cherokee Nation

B. Commencing with the Council elections of 2025, there shall be fifteen (15) Districts of the Council of the Cherokee Nation within the boundaries of the Cherokee Nation Reservation, as identified in the attached "Appendix."

C. Commencing with the Council elections of 2025, there shall be one (1) Council seat for each of the fifteen (15) Districts within the boundaries of the Cherokee Nation Reservation. The staggering of terms shall continue in accordance with existing Cherokee law.

D. Commencing with the Council elections of 2025, there shall be two (2) At-Large Council seats outside the boundaries of the Cherokee Nation Reservation. The staggering of terms shall continue in accordance with existing Cherokee law.

E. Candidates may file for only one (1) seat and must receive a majority of votes cast for that seat.

F. The Legislative Branch has previously conducted and determined apportionment for each District in accordance with Cherokee law.

G. Individuals elected to the Council of the Cherokee Nation for each District shall maintain their domicile within the boundaries of that District. Failure to do so shall result in forfeiture of the office and the position being declared vacant.
